COMMITTEE OF DGQA
1. In accordance with the Ministry of Personnel and Training, Office Memorandum No 11013/3/2009-Estt(A) dt 21 Jul 2009 and 03 Aug 2009, on the subject of “ CCS (Conduct) Rules, 1964 – Guidelines regarding prevention of sexual harassment of working women in the workplace” a committee as under has been constituted for investigating complaints of sexual harassment of women at workplace in DGQA HQ and Establishments:-

           CQA(W), Jabalpur
 
(c)        Smt Gayatri Devi, SSO-I                -          Member

(e)       Smt Bindiya Balan, SSO-II             -          Member
           CQA(L), Bangalore
 
2.         The committee will enquire into all types of complaints relating to sexual harassment of women at work place submitted by women employee of DGQA cadre including DQA(N), DQA(WP) but excluding AFHQ cadre.
 
3.         A women employee can submit her complaint regarding sexual harassment at work place to the chairperson of the committee directly. In case the complaint is submitted to establishment, the HOE will transfer the complaint to the Chairperson for further necessary action.
 

4.         The chairperson of the committee is authorized to co-opt a local NGO (Non-Govt Organisation), if available, as member of the committee. The Chairperson and any two members will be the quorum for the committee.

PROTECTION AGAINST SEXUAL HARASSMENT OF WOMEN AT WORKPLACE
IMPLEMENTATION OF THE GUIDELINES CONTAINED IN SUPREME COURT’S ORDER IN THE CASE OF SEXUAL HARASSMENT OF WOMEN AT THE WORKPLACE AND OTHER INSTITUTIONS.
The Hon’ble Supreme Court in its order dated 13-08-1997 has passed an order laying down the norms and guide lines to be followed by the employers for tackling the incidents of sexual harassment of women at workplace and other institutions. The guidelines issued by the Supreme Court included setting up of a complaints Redressal forum in all work places and amendment of the disciplinary / conduct rules governing employees by incorporating the norms and guide-lines.

The Secretary Ministry of Labour has forwarded the Supreme Court’s order to Secretary Department of Defence, New Delhi for compliance. The extract of the letter is reproduced here:-

As the onus for implementation of the guidelines lies  solely on the employer,  I would urge  you to initiate immediate action to specifically ensure the following:-
  1. Bring to the notice of those working in your Ministry/Department as well as attached and subordinate offices the definition of sexual harassment as laid down by the Supreme Court and its express prohibition.
  2. Take all necessary action to suitably modify the Conduct Rules governing the employees to ensure that they include  express prohibition of sexual harassment and provide for appropriate penalties against the offender.
  3.  Take all steps necessary to ensure that appropriate work condition are provided in respect of work, leisure, health and hygiene to further ensure that there is no hostile environment towards women at workplace and no women employee has reasonable ground to believe that she is disadvantaged in connection with her employment.
  4. Set up a complaint mechanism in your Department to deal with complaints of sexual harassment.   The modalities for setting up such mechanism may please be seen at para 7 of the judgment.
Accordingly in DGQA a committees have been constituted in compliance of the directions of the Supreme Court.
